Terms of service

Last updated

These terms are an agreement between ASL Information Services Private Limited, a company based in Hyderabad, Telangana, India ("Telani", "we", "us"), and the business that uses Telani ("you"). By creating an account or using Telani, you accept them on behalf of your business and confirm that you're allowed to. If you have signed a separate agreement with us, that agreement takes priority where the two differ.

1. The service

Telani answers your business's phone calls, books and moves appointments, takes messages, makes the calls you set up (and, once texting is available, sends the texts you set up), and shows every call in your console with a transcript and a summary. We keep improving it, so features change. We will tell you before we remove a main part of your plan.

2. Your account

Give accurate details when you sign up, keep sign-in details safe, and tell us straight away if you think someone has used your account without permission. You're responsible for what the people you invite to your workspace do in it.

3. Plans and payment

Every account starts on the Free plan, with 100 minutes a month. Before a paid plan starts, we confirm the plan, its included minutes and its price with you in writing; our pricing page shows our current plans. Unless we agree otherwise in writing, prices are in US dollars and don't include taxes. When your plan's minutes for the month run out, new calls are refused until the 1st of the next month or until your plan is raised; we don't charge for minutes beyond your plan. You can change or cancel a paid plan at any time by writing to us; a cancellation takes effect at the end of the period you've paid for, and fees already paid are not refunded unless the law requires it.

4. Rules for calls and texts

You decide who Telani calls and texts, so you're responsible for doing it lawfully. In particular, you must:

  • have each person's consent before Telani calls or texts them, including written consent where the law requires it, such as for marketing. In the United States, Telani's AI voice counts as an artificial voice under the Telephone Consumer Protection Act;
  • honour requests to stop, and the national and state do-not-call registries;
  • call and text only at the times the law allows;
  • give callers any notice your business is required to give, and get any consent the law requires to record or transcribe a call;
  • register for business text messaging where carriers require it (in the United States, 10DLC).

Don't use Telani to harass, deceive or threaten anyone, to pretend to be someone else, or for anything illegal. We may block or stop calls and texts that break these rules.

5. Not an emergency service

Telani can mark a call as urgent for your team, but it can't send help. Make sure your callers know what to do in an emergency.

6. Health information

Telani does not give medical advice, diagnose or recommend treatment. If HIPAA or similar health-privacy rules apply to you, talk to us before you use Telani with patients' health information: we do not yet sign Business Associate Agreements.

7. Your data

The information that comes into Telani through your account, such as call records, transcripts, messages and anything you upload, is yours. You allow us to use it only to provide, secure and support Telani for you, as our privacy policy describes. For information about your callers, we act as your service provider, and you're responsible for having the right to give it to us.

Your administrators can export or delete a caller's calls, transcripts, messages taken on calls, bookings and follow-ups from your console at any time, by phone number. If you close your account, your data is permanently deleted 30 days later.

8. Content Telani writes

Transcripts, summaries and other content Telani writes are produced automatically and can contain mistakes. Check anything important, such as a booking or a reported symptom, before you rely on it.

9. Availability and support

We work to keep Telani running at all times, but we can't promise it will never be interrupted, for example during maintenance or a phone carrier's outage. Support is by email at hello@gettelani.com.

10. Suspending or closing an account

You can close your account at any time. We may suspend or close an account that isn't paid, that breaks these terms, or whose calls or texts put people or Telani at risk. Where we can, we tell you first and give you time to fix the problem.

11. Warranties and liability

Telani is provided "as is". To the extent the law allows, we disclaim implied warranties, such as fitness for a particular purpose. Neither of us is liable to the other for indirect or consequential losses, such as lost profits. Our total liability under these terms is limited to the fees you paid us in the 12 months before the claim. These limits don't apply where the law doesn't allow them.

You will defend us against, and cover our losses from, claims arising from the calls and texts you direct Telani to make, from your data, or from your breaking section 4.

12. Law and disputes

These terms are governed by the laws of India, and the courts in Hyderabad, Telangana have exclusive jurisdiction.

13. Changes to these terms

We may update these terms. We post the new version here and email your account's administrators before a material change takes effect. If you keep using Telani after that, the new terms apply.
